Well, one way of getting caught is to announce your illegal activities to the public...
Your chances are zero if you have encryption on the wireless signal (if it's encrypted, you would have had to enter a password to access the wireless signal), because they need probable cause to check what you're doing on your private network. Plus, I can almost guarantee that unless you're living right next to a police station or technical security professional, people aren't checking your network to see if you're downloading illegal material. If someone hacks in, they're breaking the law anyways and illegal material they present is inadmissible, because it was illegally obtained.
